In electric power: the charge, if any, imposed for the recovery of the Stranded Debts, Stranded Contract Costs of NPC, and Stranded Contract Costs of Eligible Contracts of Distribution Utilities and other purposes pursuant to Section 34 of the Act [Section 4(rrrr), Rules and Regulations to Implement Republic Act No. 9136, Entitled “Electric Power Industry Reform Act of 2001”]

In electric power, upstream oil & gas: the charge imposed for the recovery of the stranded contract costs and stranded debts, and other purposes pursuant to Section 34 of the EPIRA, which shall be passed on and collected from all electricity end-users on a monthly basis by the distribution utilities and National Transmission Corporation or its concessionaire [Section 4.12, DOE-DOF Joint Circular No. 1, Series of 2020, The Implementing Rules and Regulations of Republic Act No. 11371, ‘An Act Reducing Electricity Rates An Act Reducing Electricity Rates by Allocating a Portion of the Net National Government Share from the Malampaya Natural Gas Project for the Payment of the Stranded Contract Costs and Stranded Debts’ Otherwise Known as the ‘Murang Kuryente Act’]

Note: Under the Murang Kuryente Act of 2019 IRR, the term is written as “Universal Charge (UC)”. The IRR also adds the following: purposes for the charge (stranded contract costs, stranded debts, and others pursuant to Section 34 of the EPIRA), “electricity” to describe the end-users (which is written as “end user” under the law), and passing on and collection from end-users not only by distribution utilities but also the National Transmission Corporation or its concessionaire. It also drops “non-bypassable” to describe the charge.
